Wedding, Portrait & Event Term’s & Conditions

1.0 OWNERSHIP RIGHTS AND RESPONSIBILITIES
Client has personal usage rights for the photographs taken by the Photographer. Client may share, distribute and print from the supplied images and share with others for none commercial usage. The Photographer retains the usage rights to use selected images for his promotional usage on websites, on social media and in printed magazines. Usage will be limited to Client’s personal usage, Photographer’s promotional usage and approved third party usage only with full approval of the Photographer. If images are used in any commercial or promotional way please credit the Photographer ‘Keane Media Services’. 

2.0 PAYMENT REQUIREMENTS
To reserve the event date, Photographer requires a scheduling payment of £100; Photographer will not hold any date as a confirmed booking without receipt of said payment. Said payment is nonrefundable for any reason, unless at the Photographer discretion. The remaining balance must be received by photographer no later than 14 days before the event date. 

3.0 CANCELLATION
If Photographer has to cancel this contract for reasons beyond their control (death, injury, sickness etc.) Liability shall be limited to a full refund of all monies paid including the scheduling payment. After 14 days of signing this booking form and agreeing to services by this contract, a refund is only granted at the discretion of the Photographer. Should the said wedding be a postponement, then, subject to availability, all money paid may be applied to the new wedding occasion. 

4.0 FORCE MAJEURE OR ACT OF GOD
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control. 

5.0 ARTISTIC STYLE
On their own behalf, and on behalf of the subjects of the photography: Clients acknowledge that they are familiar with the Photographer’s portfolio and are requesting services with knowledge of the Photographer’s style; that Photographer’s work is constantly evolving; that Photographer’s services are of unique and artistic nature; that the photographs may be different from photographs taken by the Photographer in the past; and that in creating the photos, the Photographer shall use his personal artistic judgment to create images consistent with his personal vision of the Event, which vision may be different from the Client’s and /or the Subject’s vision of the Event. Accordingly, Client acknowledges that the photographs shall not be subject to rejection on the basis of taste or aesthetic criteria. 

6.0 DISCLAIMER
Photographer agrees that every effort will be made to provide high quality photographic services. In the unlikely event that a catastrophic mechanical failure should occur to Photographer’s equipment or transport and the Photographer is unable to provide Client with the agreed upon photography services and/or products, Photographer’s liability shall be limited to a full refund of all monies paid. Photographer has full Public Liability, and Professional Indemnity Insurance. Photographer and Client agree that Photographer is not responsible for any damages, emotional or otherwise. While all reasonable care will be taken to fulfil the wishes of the client, no financial responsibility over and above the sum of monies received by Photographer is an amount to be claimed against in the event of malfunction or theft of equipment, digital files, albums etc. Client agrees that Photographer may use any photograph for Publicity Purposes. Such publicity and advertising may include publication on Photographer’s website, other social media and in printed media. 

7.0 Photographer cannot be responsible for unusable shots due to distractions from Client’s guests (i.e. eyes being closed) and other circumstances beyond the Photographers control. Photographer is not responsible for goods not picked up or delivery arranged for beyond six months after completion. In the unlikely event of a complaint, any complaints should first be raised by the Client with the Photographer in writing or by email within 21 days from the date of receipt of images. 

8.0PHOTOGRAPHY DELIVERY
The photographer will provide edited high-resolution final edited jpeg images, made available by digital download from Downloadable Link. If Client requires images on DVD or other method, please notify Photographer as this will be additional. Photographer’s preference is for digital delivery with no provision of DVD or USB media. The Client may share the Dropbox folder with friends and family and their professional parties involved with the wedding. Photography may be shared on social media, blogs or in printed magazines providing the photographer is referred as ‘Keane Media Sercvices’.
